1. Operator and related documents
Qfindo (the qfindo.com website, the mobile applications and their interfaces) is owned and operated by TRIO LABS LLP, business identification number 260840005834, Almaty, Republic of Kazakhstan. Address for legally significant correspondence: support@qfindo.kz.
This Agreement applies together with the Privacy Policy, the Posting and Moderation Rules, the Safety Rules and the Paid Services Terms. All of them form an integral part of the agreement between the user and the operator. Where the documents differ, this Agreement prevails unless expressly stated otherwise.
2. Acceptance and versioning
This Agreement is a public offer. Registering, ticking the consent box or using the service in any way constitutes full and unconditional acceptance of the current edition. The operator records the version number and the date and time of acceptance; that record is evidence of consent.
The operator may amend this Agreement. A new edition is published with a version number and an effective date, and applies to relations arising after it takes effect. Continued use after publication constitutes acceptance. Where the law requires fresh consent, it is requested separately.
3. Subject matter and legal nature of the service
The operator provides a technical platform on which users themselves post listings about lost and found items, exchange messages and search for probable matches.
The operator is not: the owner of any item; a party to any arrangement between users; an agent, commission agent or representative of either side; a search service; a lost property office; a carrier; an insurer; a pawnbroker; a body that establishes title to an item; or a guarantor of users' obligations.
Verifying that an item belongs to somebody, agreeing terms, meeting and handing over are done by users themselves, of their own will, in their own interest and at their own risk.
4. The user, age and account
Independent use of the service is permitted to persons aged sixteen or over with the necessary legal capacity. A minor's legal representative is answerable for the minor's actions.
The user must give accurate information, keep it current, and safeguard their password, one-time codes and device. Everything done using the user's credentials is deemed done by the user. Transferring an account to third parties, or creating accounts to circumvent blocks, limits or moderation, is prohibited.
5. Posting listings
Creating and ordinarily publishing a listing is free. The user alone is answerable for the accuracy and completeness of the description, for the lawfulness of the photographs and other materials, and for the absence in them of third parties' personal data, legally protected secrets and objects of somebody else's exclusive rights.
A person who finds an item bears the obligations laid down by the legislation of the Republic of Kazakhstan in respect of found property until it is lawfully handed to its owner or to a competent authority. The operator does not take items into custody and takes no part in handing them over.
6. User content and the licence to the operator
Exclusive rights in posted content remain with the user. By posting content the user grants the operator a non-exclusive, royalty-free licence, valid in all countries for the period of posting and a reasonable period afterwards, to store, reproduce, technically transform, cache, index and make the content available to the public to the extent needed to operate the service, moderate it, search for matches, keep backups and provide promotion services the user has ordered.
The user warrants that they hold every right and consent needed to post the content and that posting it infringes no third-party rights.
7. The operator's rights in the service
The software, interfaces, design, databases, catalogue structure, trade mark and the Qfindo name belong to the operator and are protected by law. No rights in them pass to the user beyond the right to use the service for its purpose.
The following are prohibited: copying, extracting or re-using a substantial part of the listings database; automated collection of data, including parsing, scraping, bots and scripts, without the operator's written permission; decompiling or modifying the software; building derivative services on Qfindo data; and anything that places an excessive load on the infrastructure.
8. Ranking and promotion
The order and composition of results are determined by the operator and depend on the kind of listing, the locality, the category, distance, date, relevance to the query and whether promotion has been paid for. Promoted listings are marked as such.
The operator does not guarantee any number of views or responses, or any position in the results, unless expressly stated in the description of a particular paid service.
9. Verifying the owner and handing over
Users verify for themselves that an item belongs to somebody, choose the place and time of a meeting and decide whether to hand the item over. We recommend keeping one distinguishing feature unpublished and asking the claimant to name it.
A confirmed telephone number means only control of that number at the moment of confirmation. It does not confirm identity, good faith, legal capacity or title. The operator does not check users' documents and does not identify them.
10. Paid services
Publishing listings is free. Only additional services the user expressly chooses are paid for. Their list, price, duration and refund rules are set out in the Paid Services Terms, which form part of this Agreement.
11. Moderation
The operator may, but is not obliged to, check content automatically and manually. The operator may at its discretion refuse publication, require corrections, hide, restrict or remove material, and restrict or block an account, where the law, this Agreement, the operator's other documents, third-party rights or safety requirements are breached.
Moderation reduces risk. It is not a guarantee that listings are accurate or that users act in good faith.
12. Complaints and the pre-action procedure
A complaint is submitted through the service or to support@qfindo.kz. A reasoned reply on content and platform actions is given within twenty calendar days; a consumer claim about a paid service is answered within the period set by consumer protection legislation.
Following the pre-action procedure is mandatory. Court proceedings may be brought once the time for replying has expired or a refusal has been received.
13. Prohibited conduct
The following are prohibited: fraud and attempted fraud; demanding prepayment, a reward or a ransom for returning an item; appropriating found property; phishing and fake payment or delivery links; asking for a one-time code, password or card details; impersonating the operator's staff, a public authority or another person; distributing malware; spam and bulk messaging; threats, insults, harassment and incitement of hatred; posting information or goods prohibited by law; and anything aimed at circumventing the service's technical limits.
14. No warranties
The service is provided "as is". The operator does not warrant that an item will be found, kept safe, identified or returned; that a response or listing is accurate; that automated matching will produce a result; that the service will run without interruption or error; or that defects will be fixed within any particular time.
Automated matching produces probabilities, not proof that an item belongs to anybody.
15. Limitation of liability
To the fullest extent permitted by the legislation of the Republic of Kazakhstan, the operator is not liable for: users' acts and omissions; the content of listings and messages; the outcome of meetings and handovers; damage to, loss of, or failure to return an item; money transfers between users; lost profit and indirect losses; or failures of communication networks, payment systems, application stores and other third parties.
The operator's aggregate liability to a user on any ground is limited to the amount that user actually paid the operator for paid services in the twelve months preceding the event giving rise to the claim, and where no such payments were made, to the amount of one monthly calculation index.
This clause neither excludes nor limits the operator's liability where the law forbids such limitation, and does not limit consumer rights conferred by the legislation of the Republic of Kazakhstan.
16. Indemnity
The user shall reimburse the operator for documented losses, fines and expenses, including legal costs, arising from the user's breach of this Agreement, of the law or of third-party rights, including third-party claims against the operator caused by the user's conduct.
17. Force majeure
The operator is released from liability for failure to perform, or improper performance, caused by force majeure, including natural disasters, hostilities, acts of public authorities, accidents, interruptions to power and communications, large-scale failures of infrastructure suppliers, and unlawful acts of third parties aimed at disrupting the service.
18. Changing and discontinuing the service
The operator may change the composition and functionality of the service, introduce, alter and discontinue particular features, and temporarily restrict access for maintenance, security, incident recovery and compliance with the law. The operator may discontinue the service on at least thirty calendar days' notice, except where discontinuation is required by law or caused by force majeure.
19. Suspension and blocking
The operator may restrict access to particular features or block an account where this Agreement is breached, where there are reasonable grounds to suspect fraud, where well-founded complaints are received, or at the request of a competent authority. The user may appeal by writing to support@qfindo.kz.
20. Deleting the account
The user may delete their account at any time in the service settings, or by writing to the address given at qfindo.com/account-deletion. Deletion does not end obligations that arose before it, does not undo services already provided, and does not affect data that must be retained by law.
21. Organization accounts
Legal entities and sole traders may connect an organization account on the terms published in the relevant section of the service. Such an account publishes found-item listings only. The organization is answerable for the accuracy of its details and for the acts of those acting on its behalf.
22. Legally significant notices
The operator sends legally significant notices to the telephone number in the account, through notifications in the service, or by publishing them on the website. A notice is deemed delivered when sent or published. The user must keep those channels available.
23. Personal data
Personal data is processed in accordance with the Privacy Policy and the legislation of the Republic of Kazakhstan on personal data and its protection.
24. Governing law and disputes
The law of the Republic of Kazakhstan applies. Disputes not settled through the pre-action procedure are heard by the court at the operator's location, unless a mandatory rule of law, including consumer protection legislation, provides otherwise.
25. Final provisions
If any provision is held invalid, the remaining provisions stay in force. This Agreement creates no employment, agency, partnership or joint venture relationship. Clauses 6, 7, 13–17, 22 and 24 survive the end of use of the service and deletion of the account.
This Agreement is made in Russian, Kazakh and English. In case of any difference in interpretation, the Russian text prevails.
