1. Provider and subject matter

Services are provided by TRIO LABS LLP, business identification number 260840005834, Almaty, Republic of Kazakhstan, support@qfindo.kz. These Terms are a public offer and form part of the Terms of Use.

Creating and ordinarily publishing a listing is free. Only additional services the user expressly chooses are paid for.

2. The services

The following may be paid for: TOP promotion, the "Urgent" mark, extending the posting period, automated matching, a one-off notification to users nearby, opening contact details in a claim, and other items in the current catalogue.

The name, the price in tenge, the duration, the impressions quota or other measurable outcome are shown before the order is confirmed and are recorded in the order. The order constitutes the terms of that particular service as agreed between the parties.

3. Formation of the contract and payment

The contract is formed when payment is confirmed by the payment organisation or the application store. Opening the pricing screen, creating a listing, or creating an order with the status "awaiting payment" is not consent to a charge and creates no obligation to pay.

Card payments are made on the payment organisation's secure page. The operator neither receives nor stores the card number, the CVC code or online banking credentials. Entitlement to a service is granted only once confirmation is received from the payment organisation or the application store.

Where an unpaid payment already exists for an order, a repeat attempt uses the existing order rather than creating a duplicate.

4. No subscriptions

The current catalogue contains no subscriptions, automatic renewals or recurring charges. Every purchase requires a separate action by the user. A subscription may be introduced only with separate, clearly expressed consent and on separate terms.

5. When a service is rendered

A service is treated as rendered:

  • promotion and the "Urgent" mark — when the listing begins to be shown with the corresponding mark;
  • extension — when the posting period is changed;
  • automated matching — when the search task is queued for processing;
  • notification nearby — when the notification is handed over for sending;
  • opening contact — when access to the contact details is granted.

From that moment the service is treated as performed in the relevant part, whatever outcome the user achieved.

6. What is not the outcome of a service

The operator does not guarantee and does not undertake to secure: the return or discovery of an item; any number of responses; a response from any particular user; a positive result from automated matching; or views beyond an expressly stated quota.

Delivering the stated duration, quota or action constitutes proper performance. The absence of the outcome the user hoped for is not, in itself, non-performance and does not give rise to a refund.

7. Technical failures and double charges

If money has been taken but the entitlement was not granted, if the service failed to start for a reason attributable to the operator, or if the same order was paid for twice, the user should send to support@qfindo.kz: the order number, the account's telephone number, the date and amount of the transaction, and bank confirmation without the full card number or CVC code.

After checking, the operator will, at its option, provide the service or initiate a refund.

8. Cancellation and refunds

Before the moment set out in clause 5 the user may cancel the service. The amount paid is refunded less the expenses actually incurred by the operator.

After that moment, refunds are made in the cases provided for by the legislation of the Republic of Kazakhstan, including improper performance. No refund is made for the unused remainder of a promotion period once display has begun, unless the law provides otherwise.

Refunds are made by the same means as the payment, within the period set by law and by the payment organisation's rules. Commissions retained by the payment organisation or the application store are not refunded by the operator where the operator did not receive them.

Mandatory consumer rights under the legislation of the Republic of Kazakhstan remain in full and are not limited by these Terms.

9. Purchases in application stores

A purchase made through Google Play or the App Store is processed by that store under its own rules, including its refund rules. The operator confirms the status of the service but does not control the payment or the refund in such a purchase. The store's commission is retained by the store and forms no part of the operator's fee.

10. Prices and changes

The operator may change prices and the composition of the catalogue. A change of price does not apply to an order already paid for. The price of a service is stated inclusive of taxes payable under the legislation of the Republic of Kazakhstan.

11. Complaints

A complaint about a paid service is sent to support@qfindo.kz with the order number. A reasoned reply is given within the period set by consumer protection legislation, and no later than ten calendar days from receipt of the complaint unless the law provides otherwise.
